How to Update Your State Information After a Move

If you've moved to a different state, updating your estate planning documents to reflect your new state of residence is important. Trust & Will creates state-specific documents, so state laws around taxes, property, healthcare, and family matters can affect how your plan works.

How to Update Your State (Will-Based Plans)

  1. After logging in, click Documents from the menu bar on the left and select the Summary tab at the top.
  2. Find the Basics section.
  3. Click on your current state to re-enter the questionnaire flow.
  4. Choose your new state from the dropdown.
  5. Click Save & Continue to apply the changes.
  6. Continue through the rest of the questions to ensure all questions are answered and up to date.

Once updated, re-print and re-sign your documents to ensure everything reflects your current state accurately.

Trust-Based Estate Plan Considerations

If you have not yet signed and funded your Trust, you can follow the same steps above to change your state.

However, if you have a signed and funded Trust-based Estate Plan, please note that our platform does not currently support updating an executed Trust to a new state. A proper update would require a restatement of your current Trust, which is not available on our platform at this time.

Your options are:

  • Create a new Trust for your new state (note: assets previously titled in your Trust would need to be retitled)
  • Consult an attorney who can perform a restatement without requiring assets to be retitled

Although updating your state for Trust plans isn't legally mandatory since your Trust is recognized across all states, maintaining current information is highly recommended for consistency and legal clarity. Updating your state also ensures that your estate planning documents conform to the laws of your new state of residence.
