Naming Trust & Will as Your Successor Trustee or Executor

For eligible members, Trust & Will offers the option to name Trust & Will as your Successor Trustee (for Trust-based estate plans) or your Executor (for Will-based estate plans). This can provide added peace of mind by giving your loved ones a professional option to help carry out your wishes when the time comes.

What this means

  • Successor Trustee (Trusts): Steps in to administer your Trust if you can no longer serve or after your passing.
  • Executor (Wills): Helps carry out your Will instructions after your passing.

Eligibility (may vary)

This option is available to some members, including:

  • Single-user Trusts
  • Joint Trusts (married couples creating one shared Trust)
  • All Will users
    • Married Will users must name the surviving spouse as the primary executor though - T&W can then be the first backup executor.

This option is not available if:

  • You are married and creating separate Trusts
  • Your plan was purchased through an advisor or financial partner
  • You want to name Trust & Will as a co-trustee/co-executor (not supported)

Backup required

If you select Trust & Will, you must also name at least one backup successor trustee or executor. If Trust & Will is unable to serve, the role automatically passes to your backup.

Does this guarantee that Trust & Will will serve?

This does not automatically guarantee that Trust & Will will serve. After a member passes away, Trust & Will will review the plan and determine whether we (or a trusted partner) can formally accept the appointment. If we decline, your backup takes over.

Pricing

There is no cost today to choose Trust & Will in your plan. Fees only apply if and when Trust & Will formally accepts the role after your passing. Professional trustee services typically range from 1%–2% of Trust assets annually (pricing may vary). This would be similar for executor fees as well.

Document storage

Trust & Will does not store original signed documents. We recommend keeping originals in a safe place, ensuring trusted loved ones know where they are, and uploading copies to your Digital Safe for backup.

When the time comes, loved ones can contact Support with the original documents in hand to begin the intake process.
