Handling Clients' Existing Trusts Created Outside of Trust & Will

Reviewing Existing Documents with Document Extraction

Before deciding on next steps for a client's existing trust, use document extraction in the Advisor Portal to get a clear picture of what's already in place. Upload the client's existing estate planning documents, and the tool will automatically extract key details and organize them for review.

Once uploaded, you can generate a summary — an AI-powered overview of the client's full estate plan across all documents — to quickly identify gaps, outdated provisions, or opportunities to discuss. This is especially useful before a restatement conversation, giving you a structured starting point rather than reading through each document manually.

For step-by-step instructions, see our document extraction article.

Trust Restatements

Trust & Will offers Trust restatements for clients who have existing Revocable Living Trusts. This process mirrors the creation of new documents but includes extra steps:

  • Additional Questions: Clients will answer more detailed questions to tailor the restatement to their current situation.
  • Incorporation of New Language: Specific language is added to align the new documents with the existing Trust's stipulations.

Since the restatement retains the original Trust's name, it typically does not require re-funding. However, it's important to note that all other existing documents such as Wills, Power of Attorney, and Advance Health Care Directives will be revoked upon the signing and notarization of the new documents.

Note: Restatements are not available in every state. Please reach out to advisors@trustandwill.com to confirm viability before proceeding.
